1. To enter, you can either attend one of the three qualifying events that will be decided prior to the start of the promotion or go to www.1070thefan.com and follow the online instructions to complete and submit an online entry.
2. One entry per person per visit or per email address. Entries must be received by June 28, 2010. All materials submitted become the property of WFNI-AM and Anheuser-Busch, Inc. and none will be returned.
3. Neither Sponsor nor any of its agencies are responsible for lost, late, misdirected, unintelligible, illegible, postage due, stolen, returned, or undelivered, entries, mail or e-mail, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network. Persons who tamper with or abuse any aspect of sweepstakes, or website, or violate website’s Terms of Service, as solely determined by Sponsor, will be disqualified. Sponsor is not responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this sweepstakes, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access. Sponsor is not responsible for injury or damage to participants or any other persons, computer or property related to or resulting from participating in this sweepstakes. Should any portion of sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in sole opinion of Sponsor, corrupt or impair administration, security, fairness or proper play of this sweepstakes, or submission of entries, Sponsor reserves right at its sole discretion to suspend, modify, or terminate sweepstakes, and randomly select winners from valid Internet entries received prior to action taken and mail-in entries. In event of a dispute regarding entries received from multiple users having same e-mail account, authorized subscriber of e-mail account used to enter will be deemed to be entrant, the winner, and must comply with these rules. Authorized account subscriber is natural person who is assigned e-mail address by Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses.
4. Forty-five (45) qualifiers will be selected in random drawings from among all eligible entries received at each participating retail location by a WFNI-AM representative whose decisions are final in all matters relating to this sweepstakes. The retail establishment is not responsible for the drawing. Qualifiers must be present and will be notified in person. Twenty (20) online qualifiers will also be selected by random drawing among all eligible entries received on www.1070thefan.com. The final five qualifiers will be chosen during the grand prize event. One (1) prize will be awarded among final qualifiers on July 1, 2010 at a time and location in metropolitan Indianapolis as designated by the radio station. Qualified finalists will be notified of specific time and location. Winner may not substitute or transfer prize but sponsor reserves the right to substitute prize with a prize of equal or greater value.
5. All prizes will be awarded. Odds of winning depend upon the number of eligible entries received. Winners may be required to complete, sign and return an affidavit of eligibility and liability and publicity release within 7 days of prize notification. In the event of noncompliance within this time period, prize will be forfeited and an alternate winner will be selected. Any prize notification or prize returned to the sponsor or its agencies as undeliverable will result in disqualification and the awarding of that prize to an alternate winner.
6. Employees and the immediate families of employees of WFNI-AM, Emmis Communications, Anheuser-Busch, Inc., its affiliates, subsidiaries, advertising and promotion agencies, wholesale distributors, and individual retail licensees are ineligible. This sweepstakes is subject to federal, state and local regulations. Taxes on prize, if any, are the responsibility of the individual winner.
7. Acceptance of prize offered constitutes permission to use winner's name, biographical information and/or likeness for purposes of advertising and promotion without further compensation as permitted by law.
8. Grand Prize: One (1) trip for two people to the MLB Home Run Derby and All-Star Game at Angel Stadium in Anaheim, CA. Package includes roundtrip airfare from Indianapolis to Los Angeles, deluxe double occupancy hotel accommodations at the Anaheim Marriott Suites for four (4) days and three (3) nights, two (2) tickets to the Home Run Derby/All-Star Workout on July 12, 2010 and the All-Star Game on July 13, 2010, daily breakfast buffet and commemorative All-Star gift bag. Estimated retail value $6,000.00. Trip must be completed on July 11-14, 2010. If winner cannot take trip when specified, the prize will be forfeited and an alternate winner selected. Meals, transportation (unless specified), gratuities and all other expenses not specified herein are winner's responsibility. Total estimated retail value of all prizes $6,000.00.
9. By accepting a prize, winner agrees to release and hold sponsors harmless from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance, possession or use of any prize, including without limitation, personal injuries, death and property damage. By participating in this sweepstakes, participants agree to be bound by all the Official Rules of this sweepstakes.
